MISSION STATEMENT

It is the mission of the Office of Judicial Affairs to educate our students, staff and faculty about the interpretation and enforcement of campus policies. We are dedicated to fostering a community of respect, and uphold due process rights for all our students.

STUDENT CONDUCT OVERVIEW

The Office of Judicial Affairs at BCC is responsible for providing a fair and educational system for administering the University’s student conduct system. The procedures in place create a safe, welcoming, and equitable campus community for all students to coexist.

The process for responding to alleged violations of the BCC Student Code of Conduct and/or Henderson Rules is outlined in Article XV of the CUNY Board of Trustees Bylaws.

It is the goal of the Office of Judicial Affairs to assist students with gaining an enhanced understanding of not only the policies, rules, and concepts of fairness and due process, but also of the rights and responsibilities of all who are a part of the College community.

By preparing students with the knowledge and tools necessary to be successful, the Office of Judicial Affairs seeks to help students understand how their decision-making and behavior can impact them and other members of the BCC community.

HOW TO FILE A FORMAL COMPLAINT

At the College, several offices and departments have a process in place to accept formal complaints.  For questions on which office and department to contact, and How to File a General Campus Complaint, you may contact the Office of Judicial Affairs at Loew Hall, room 418 or email ana.molenaar@bcc.cuny.edu.

FORMAL COMPLAINTS FILED WITH THE OFFICE OF JUDICIAL AFFAIRS

A formal complaint can be filed against any active BCC student or organization for alleged violations of University policy, occurring either on or off campus. Complaints may be originated by faculty, staff, University departments and individuals external to the University. For questions or to make a formal report  of a suspected student conduct violation, submit the Student Conduct Incident Report to Judicial Affairs via email to ana.molenaar@bcc.cuny.edu.

ONCE A COMPLAINT IS FILED

Having received a formal complaint against a student, the Office of Judicial Affairs will conduct a preliminary review of the complaint in order to determine whether the circumstances detailed in the formal complaint are sufficient to cause a formal charge to be made. The Office of Judicial Affairs consults with the Assistant Vice President of Student Success and the Vice President for Student Success (the Chief Student Affairs Officer) regarding how to proceed with a complaint, if necessary. If the Office of Judicial Affairs concludes that the complaint is sufficiently complete and involves a violation of a University policy, rule, regulation or standard of conduct, the matter is either addressed with a Mediation Conference in lieu of a formal hearing, or is sent for a hearing to the Faculty Student Disciplinary Committee (FSDC). The person(s) making the complaint will be expected to appear before the FSDC as the accuser unless the accused student agrees that a violation has taken place, and waives the right to a hearing. In certain cases, when the accuser decides not to file or pursue a formal complaint, the College reserves the right to continue to process the matter.
