The Office of the Counsel is responsible for interpreting, administering and complying with The City University of New York Board of Trustees Bylaws, city, state, and federal laws, collective bargaining agreements, and with CUNY and BCC policies and procedures. The Office serves as the liaison to CUNY’s Office of General Counsel, Office of Labor Relations, and NYC Law Department on litigation and other matters. Additionally, the Office of the Counsel provides guidance and support to members of the campus community at large.

Responsibilities

The Office of the Counsel monitors:

  • full-time financial disclosure statement reporting
  • multiple position reporting
  • adjunct instructional staff
  • graduate assistant workload reporting

The Office of the Counsel also responds to subpoenas that:

  • implicate the Family Educational Rights and Privacy Act
  • request information under the Freedom of Information Law
  • request other information or legal documents

Susan Fiore, Esq., acts as legal advisor to the President on personnel, litigation, labor and employment law, compliance and contractual agreements, leases and commercial legal matters, medical affiliations, governance, fundraising, immigration, and discipline.

Legal Counsel & Labor Designee

The Office of the Counsel also processes temporary employment applications with the U.S. Department of Labor and USCIS for tenure-track faculty in professorial titles and provides free notary republic services to faculty and staff. The office also investigates internal complaints, represents the College against external complaints, and pursues disciplinary action.

As the College’s Labor Designee, Ms. Fiore is responsible for managing employee grievances and disciplinary proceedings, advocating for and representing BCC at appeal hearings and arbitration, and collaborating with CUNY to ensure compliance with personnel policies. She is also the BCC Records Access Officer and Ethics Officer.

Ethics Training

We conduct training on ethics, confidentiality, FERPA, honoraria and gifts, mandatory financial reporting through the New York State Joint Commission on Public Ethics, Title IX, information security, and customer service to ensure BCC’s compliance with federal, state, and local laws and regulations.
